Terms of Service & Booking Conditions

By using EuroTrain services, you agree to these Terms. Please read them carefully before making a booking. These Terms are governed by the laws of the Republic of Turkiye.

1. About Us

EuroTrain (eurotrain.tr) is a European train ticket booking platform operated by Odamigo Turizm Ltd. Sti., a company incorporated and registered in Turkiye. Company: Odamigo Turizm Ltd. Sti. Tax Office: Mecidiyekoy (Istanbul) Tax ID (VKN): 6340420923 TURSAB License: 12754 (Group A) Website: https://eurotrain.tr EuroTrain acts as an intermediary between you and European rail operators. We do not operate train services ourselves. Tickets are issued on behalf of and subject to the conditions of the respective rail operators through Rail Europe (ERA) distribution network.

2. Definitions

"Platform": The EuroTrain website (eurotrain.tr), mobile applications, and all related digital services. "User" / "You": Any individual who accesses or uses the Platform, whether as a guest or registered member. "Booking": A confirmed reservation for one or more train journeys made through the Platform. "Operator" / "Carrier": The rail company providing the actual train service (e.g., SNCF, Deutsche Bahn, Trenitalia, Renfe, SBB, OBB, etc.). "Service Fee": The fee charged by EuroTrain for intermediary and booking services, displayed separately during checkout. "Fare Conditions": The specific terms of your ticket as set by the Operator, including refund and exchange rules.

3. Scope of Services

EuroTrain provides the following services through the Platform: a) Search and comparison of European train routes, schedules, and fares across multiple Operators. b) Booking and issuance of electronic train tickets (e-tickets) on behalf of Operators. c) Secure payment processing through licensed payment service providers. d) After-sales services including refunds, exchanges, and cancellations subject to Operator fare conditions. e) Customer support in multiple languages (Turkish, English, German, French, Spanish, Russian, Arabic). EuroTrain does not provide transportation services. The contract of carriage is between you and the Operator. Each Operator has its own conditions of carriage which apply in addition to these Terms.

4. Eligibility & Account

You must be at least 18 years of age or have parental/guardian consent to use the Platform and make bookings. By making a booking, you represent that all information provided is accurate and complete. Account registration is optional. You may book as a guest. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

5. Booking Process

5.1 Price Display: All prices displayed on the Platform include applicable taxes and fees. The total price, including EuroTrain service fee, is clearly shown before you confirm your booking. Prices are displayed in the currency you select (EUR, USD, or TRY). Exchange rates are indicative and may vary at the time of payment processing. 5.2 Booking Confirmation: A booking is confirmed when you complete the payment process and receive a confirmation email with your booking reference and e-ticket(s). The booking confirmation constitutes a binding contract. In accordance with Turkish Distance Selling Regulations (Mesafeli Sozlesmeler Yonetmeligi), you acknowledge that you have read and accepted the pre-contractual information before completing your booking. 5.3 Traveler Information: You are responsible for providing accurate traveler information including names, dates of birth, and travel documents where required. Incorrect information may result in denied boarding without refund. For international routes, a valid passport or national ID card may be required. 5.4 Fare Conditions: Each ticket is subject to the fare conditions set by the Operator. These conditions determine whether your ticket is refundable, exchangeable, or subject to restrictions. Fare conditions are displayed during the booking process and included in your confirmation email. EuroTrain is not responsible for changes to fare conditions imposed by Operators.

6. Payment

Payment is processed securely through our licensed, PCI DSS-certified payment service provider. EuroTrain never stores your full credit card details. All payment transactions are protected by 3D Secure authentication and comply with PCI DSS standards. Accepted payment methods include Visa, Mastercard, and other methods as displayed at checkout. Payment is charged at the time of booking confirmation. In accordance with Turkish Electronic Commerce Law (No. 6563) and Consumer Protection Law (No. 6502), all pricing information is transparently displayed before payment.

7. Cancellation, Refund & Exchange

Key Principle: Refund and exchange eligibility depends on the fare conditions set by the rail Operator, not by EuroTrain. We process your request in accordance with the Operator's rules. 7.1 Operator Fare Rules: Each ticket carries specific fare conditions determined by the Operator at the time of purchase. These may include fully flexible, semi-flexible, or non-refundable/non-exchangeable conditions. The applicable conditions are displayed during booking and included in your confirmation. 7.2 Refund Process: If your ticket is eligible for a refund under the Operator's fare conditions, you may request a refund through your EuroTrain account or by contacting us through the contact page. Refunds are processed to the original payment method within 14 business days of approval. The EuroTrain service fee may or may not be refundable depending on the circumstances. 7.3 Exchanges: If your ticket allows exchanges, you may modify your journey (date, time, or route) subject to availability and any fare difference. Exchange fees, if applicable, are set by the Operator. 7.4 Operator-Initiated Cancellations: If the Operator cancels your train service, you are entitled to a full refund including the EuroTrain service fee, or an alternative journey at no additional cost where available. This is in accordance with EU Regulation 1371/2007 on rail passenger rights. 7.5 Right of Withdrawal: In accordance with Turkish Consumer Protection Law (No. 6502) and the Distance Selling Regulations, the statutory right of withdrawal does not apply to transport services with a specific date or period of performance (Mesafeli Sozlesmeler Yonetmeligi, Madde 15/1-b). By completing your booking, you acknowledge this exception.

8. Passenger Rights

As a rail passenger in the European Union, you benefit from rights under EU Regulation 1371/2007, including: a) Right to information before and during the journey. b) Right to compensation in case of delays (minimum 25% for delays of 60-119 minutes, 50% for delays of 120 minutes or more, subject to Operator conditions). c) Right to assistance in case of delays or cancellations (meals, refreshments, accommodation where necessary). d) Right to non-discriminatory access for persons with disabilities or reduced mobility. Claims for compensation due to delays or cancellations must be directed to the relevant Operator. EuroTrain will assist you in identifying the correct Operator and provide necessary booking information upon request.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, software, and design, is the property of Odamigo Turizm Ltd. Sti. or its licensors and is protected by Turkish and international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without prior written consent.

10. Limitation of Liability

EuroTrain acts solely as an intermediary between you and the Operators. We are not liable for: a) Delays, cancellations, or disruptions to train services caused by Operators or force majeure. b) Loss or damage to personal belongings during travel. c) Denied boarding due to incorrect traveler information provided by you. d) Changes to Operator schedules, routes, or fare conditions. Our total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific booking in question. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

11. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, war, terrorism, or severe weather conditions.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of Turkiye. For disputes involving Turkish consumers, the Consumer Arbitration Committees and Consumer Courts of the consumer's or EuroTrain's domicile shall have jurisdiction, in accordance with the Consumer Protection Law No. 6502. For international users, disputes shall be resolved by the courts of Istanbul, Turkiye, unless otherwise required by mandatory consumer protection laws of the user's country of residence within the European Union. For EU residents, the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) is available as an alternative dispute resolution mechanism.

13. International Users

EuroTrain serves customers worldwide. By using our Platform from outside Turkiye, you consent to the transfer and processing of your data in Turkiye and the European Union in accordance with our Privacy Policy. If any provision of these Terms conflicts with mandatory consumer protection laws of your country of residence, the more protective provision shall prevail. For users in the European Economic Area (EEA), these Terms do not override your rights under EU consumer protection directives, including the Consumer Rights Directive 2011/83/EU. For users in the Russian Federation, People's Republic of China, and other jurisdictions, these Terms apply to the fullest extent permitted by local law.

14. Modifications

EuroTrain reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered users and posted on the Platform at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
